- Our Pre-Existing IP: All underlying frameworks, methodologies, code templates, software tools, and proprietary assets utilized by scalingby.ai remain our sole intellectual property.
- Client Deliverables: Upon full payment of applicable fees, clients receive a perpetual, non-exclusive license to use the custom automation setups, prompts, and configurations developed specifically for their business operations.
4. Acceptable Use & AI Limitations
- Lawful Use: You agree not to use our AI deployments or services for any unlawful, harmful, or abusive activities, or to generate deceptive or malicious synthetic content.
- AI Outputs Disclaimer: Due to the probabilistic nature of machine learning and large language models, outputs may occasionally be inaccurate or non-deterministic. You acknowledge ultimate responsibility for reviewing and validating AI-generated content or automated actions before external publication or customer interaction.
5. Limitation of Liability
To the maximum extent permitted by law, scalingby.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue arising out of or related to the use of our services or AI configurations.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of South Australia, without regard to its conflict of law provisions.
